We intend to marry when he gets here. Does anyone know if that makes him automatically allowed to stay in the USA? Also will he be able to work here, and/or what does he need to do to be able to work here? Any and all advice about moving to USA from Scotland will be MUCH appreciated, thanks!

    Before you marry him, have you ever spoken to him? You might not be able to understand his speech.

    They have the thickest accent I have ever heard.

    yes, after you got married you should apply for his change of status to the immigration office so that he will allowed to stay here and if he wants to work, he needs to apply for a work authorization. you can file those 2 at the same time, that’s what we did. i came from a foriegn country and my hubby is an american, so i am here in the USA enjoying all the opportunities of this great land.

    both of you should be in contact with the US Consulte’s office in Scotland and well as the US immegration office here. There’s a lot of paperwork to fill out before hand and afterwords to make him legal to stay.

    You can file for a K1 Fiancee Visa. The form is I 129F, you can find it on USCIS.gov. The K1 process can take 6 months to a year, once the Visa is granted- he can legally enter the US and has 90 days to marry. After you get married, you can then file for EAD and AOS. Employment and Adjustment of Status.After the Adjustment of Status is granted, he will receive a 2 year conditional Green Card, 3 months prior to the expiry on that he can file to remove conditions and receive a 10 year Greencard.

    Go to http://www.uscis.gov and go file a petition for a Fiancee visa. What it is they would give him a visa to move to the US but you guys has to be married within 90 days if not he goes back to scotland.
